Publix, the largest grocery store chain in Florida, has announced it will permit customers to carry firearms openly within its stores across the state. This decision follows a recent appeals court ruling that invalidated Florida’s open carry ban.

Florida Attorney General James Uthmeier stated last month that the 1st DCA’s decision in McDaniels v. State is binding on all trial courts in Florida, making open carry legal as of September 25, 2025. A Publix spokesperson confirmed to FOX Business that the company adheres to all federal, state, and local laws.

Private businesses can still prohibit weapons on their premises, with exceptions including courthouses, schools, and government facilities. Uthmeier’s guidance memorandum clarified that violating a property owner’s warning to leave would constitute armed trespass, a third-degree felony.

Winn-Dixie, a Publix competitor, maintains its policy against firearms inside stores, emphasizing the importance of customer safety and comfort.

Customer reactions are mixed. Some support the change, feeling it increases awareness, while others express concerns about anxiety caused by visible firearms. One customer noted that they believe in their governor’s decision to allow open carry.
